This guide is for a homeowner whose interior designer or contractor has taken money and stopped, delivered poor work, or keeps demanding extras. It sets out the routes in the order most people should try them. It is an evidence workflow written by an editorial team. It is not legal advice. Facts, limitation periods and jurisdiction need a lawyer’s check before you file anything.
Three problems look alike from the outside but need different routes. A contractor who has gone quiet may have cash-flow trouble, a dispute about scope, or an intention to disappear. Work through the steps below and let the record show which it is.
What should you do in the first 48 hours?
Stop paying. Do not release the next instalment to “keep them motivated.” Money paid after a problem is the hardest money to recover.
Then preserve the record before anyone changes the site or deletes a chat.
- Photograph every room with the phone’s date stamp visible in the file details. Include half-finished items, damaged material and stored stock.
- Export every WhatsApp chat with the designer, contractor and site supervisor, with media. Save emails as PDF.
- Collect every quotation, revised quotation, BOQ, drawing and the signed scope or agreement. Note which version was accepted.
- List every payment with date, amount, payee name, bank and UTR or transaction number. Mark cash payments and whether any receipt exists.
- Save supplier invoices, delivery challans and any material bills you were shown.
Keep originals unchanged. Work from copies. If you need a method for the site record, the snag and inspection record gives a room-by-room format that a third party can follow.
How do you send a notice that a commission will take seriously?
A notice is a dated, numbered letter that states the facts, the failure and what you want by when. Its purpose is to show that you gave the other side a fair chance before you went further.
- Address the entity named on the quotation or agreement, and the individual who signed, at the address they published.
- State the agreement date, the accepted scope and the total price.
- List every payment with date and amount.
- Describe each failure as a fact: item, drawing reference, what was promised, what exists.
- State the remedy you want: complete by a date, correct named items, or refund a stated amount.
- Give a response deadline of seven to fifteen days. Interio’s editorial position is that fifteen days is fair for most site disputes.
- Send it by email and by registered post with acknowledgement due. Keep the postal receipt and tracking page.
Do not mix opinion into the notice. “Your carpenter is useless” proves nothing. “Wardrobe W2 has no back panel and the shutters do not close, against drawing D-04 rev 2” is a fact a reader can check. If the contractor replies, answer in writing and keep the thread. A partial offer is still a record. If they do not reply by the deadline, the notice becomes the first exhibit in every route below.

Most homeowner disputes belong in the first two rows. The criminal route is narrower than people expect. Arbitration exists only if you signed a clause creating it.
How does the National Consumer Helpline work?
The National Consumer Helpline is the pre-litigation route run by the Department of Consumer Affairs. Call 1915 or register the grievance on the portal with your notice and payment records attached.
The helpline forwards the grievance to the business and tracks the response. It cannot force a refund. Many disputes still settle here because a registered grievance signals that a commission complaint is next. Register even if you expect no reply. The reference number is useful evidence of your attempt to resolve the matter.
When can you file with a consumer commission?
The consumer commission route sits under the Consumer Protection Act 2019. The Department of Consumer Affairs publishes the Act and rules on the consumeraffairs.nic.in site. Complaints can be filed online through e-Daakhil or in person at the commission.
Check four points before filing.

A lawyer is not mandatory in a consumer commission. Many homeowners file themselves with a well-organized file. A lawyer still helps when the claim is large, the other side is represented, or the facts are contested.
Under the 2019 Act the commission is chosen by the amount you paid as consideration, not by the compensation you claim. Compensation can still be sought; it does not change which commission hears the case. Keep any compensation figure tied to actual loss you can show, such as rework quotes from another contractor, because an inflated figure damages your credibility.
How should the complaint be written?
A commission reads facts by date. Write the complaint so a stranger can follow the money and the work without your explanation.
- Parties: your name and address; the business name, address and the individual who dealt with you.
- Agreement: date, accepted quotation or agreement reference, total price, agreed timeline.
- Payments: a dated table of every amount paid with the transaction reference.
- Work done: what exists on site today, item by item, against the accepted scope.
- Deficiency: what is missing, defective or substituted, with the drawing or BOQ reference.
- Notice: the date you sent notice, how it was sent, and the reply or silence.
- Relief: the exact amount or the exact completion or correction you want, and why.
- Annexures: the agreement, quotations, payment proofs, photographs, notice and postal receipt, numbered in the order you cite them.

When does a police complaint fit?
A police complaint fits when there was dishonest intention from the start. Examples are a fake business identity, forged supplier invoices, a contractor who took a large advance and never began, or a person who took money for material that was never ordered.
The relevant offences now sit in the Bharatiya Nyaya Sanhita 2023. Cheating is section 318 and criminal breach of trust is section 316. Take the notice, payment proofs and identity evidence to the police station with jurisdiction over the place where the money was paid or the work was to happen.
Two limits matter. First, the police may treat a pure non-performance dispute as a civil matter and decline to register an FIR. A contractor who started, did poor work and then argued about extras is usually a civil dispute. Second, an FIR starts an investigation and does not by itself recover money. Recovery still depends on a court order or a settlement.
Do not use a police complaint as pressure in a dispute that is really about quality or scope. A complaint later shown to be a civil matter can weaken your position in the commission.
Does arbitration or a civil suit apply?
Arbitration applies only if the signed agreement contains an arbitration clause. Read the agreement. If the clause exists, the dispute normally has to go to arbitration instead of a civil court, though consumer commission access is a separate question a lawyer should check. Arbitrator fees are real money, so weigh them against the claim.
A civil suit for recovery of money is the slow fallback. It fits when you are not a consumer under the Act, the claim falls outside the commission’s reach, or the other routes have failed. It costs court fees tied to the claim value plus a lawyer, and it takes years.
What decides whether you actually recover money?
Winning an order and recovering the money are different steps. Recovery depends on facts that were fixed the day you paid.
- Who did you pay? Money sent to a company account with a GST registration is easier to trace and enforce against than money sent to an individual’s personal UPI.
- Who invoiced you? If the invoice names a different entity from the one you paid, both may deny responsibility.
- Does the entity exist and hold assets? A proprietorship with no office and a rented workshop has little to enforce against.
- Did you pay cash? Cash without a signed receipt is almost impossible to prove.
This is why the advance payment rules and the verification routine matter before the first payment. After the fact, the best you can do is document exactly who received what.
Why not file under RERA?
The Real Estate (Regulatory and Development) Act regulates real-estate promoters and registered projects. It covers a builder who sold you the flat. It does not cover an interior designer or contractor you hired for work inside a flat you already own. A RERA authority will not hear a complaint against an interior contractor. Do not spend time there.

Questions homeowners ask at this stage
Should I let them finish so I do not lose the advance? Only under a written revised schedule that ties every further payment to checked work. Paying more to protect earlier money usually adds loss. The scams guide explains this pattern.
Can I withhold the balance? The agreement decides. Record the reason in writing and keep the withheld amount separate. Do not spend it on another contractor before you have documented the deficiency.
The material on site is not what was quoted. Is that fraud? It is a deficiency you can prove with the quote and the plywood and material checks. Whether it is fraud depends on intent, which is a question for the police or a court, not for you to assert.

Interior Designer Problems and Complaints: An Evidence Guide
First decide whether the problem is urgent
If a contractor has stopped coming after taking a large advance, or is pressing for money outside the schedule, read how interior contractor scams work alongside this page. The pattern tells you which evidence matters most.
Stop work in the affected area and seek an appropriately qualified independent assessment when there may be an immediate electrical, structural, fire, gas, water, access or other safety risk. Do not open concealed work or alter an installation merely to create evidence if doing so creates danger, breaches building rules or destroys the condition that needs inspection.
For non-urgent issues, avoid a rapid sequence of verbal accusations and remedial changes. Photograph the condition, record the location and date, identify the relevant contract document, and ask the responsible party to inspect. If work is still active, a contemporaneous record is more useful than a reconstructed complaint after handover.
Build one evidence file before arguing about conclusions
Use originals as the archive and redacted working copies for review. Export messages in a way that retains dates and participants. Keep the entire relevant exchange rather than an isolated screenshot that removes context.

Create an exhibit register with a stable reference such as S-01 signed scope, Q-03 revised quotation, M-14 message thread, P-22 payment record and I-08 site image. Keep personal data out of any public copy.
Separate six kinds of statement
A useful interior design company review should tell the reader what kind of statement they are reading.

Words such as scam, fraud or cheating allege more than dissatisfaction or a contract difference. Do not use them as a shortcut for proving scope, authorization, performance, loss and the relevant legal test. A precise record is both more useful to a reader and easier for the other party to answer.
Send a numbered written notice and invite a response
The notice should identify the parties and project, the evidence cutoff, each issue ID, the relevant contract or instruction, current status, requested remedy and a reasonable response date. Separate undisputed amounts or completed work from disputed items. Ask the professional to correct factual errors and provide missing approvals, measurements, invoices or explanations.
Do not demand an admission to an accusation. Ask for an inspectable outcome: attend site, explain the scope basis, provide the variation approval, issue a rectification proposal, correct an item, credit an amount or state why no action is proposed. Record delivery of the notice and every response.

Update the record when work is corrected, a credit is issued, evidence changes the interpretation or an official decision is made. A complaint page that records resolution accurately is more trustworthy than one that preserves only the initial accusation.
